Terms of sales

1. Generality

These general conditions of sale make it possible to govern all contractual relations between any user of the online store www.raccordspro.com and the company SAS AXESSPACK® with a capital of € 120,000 whose head office is located at 2507 avenue de Europe, Les pavillons de Sermenaz, Bâtiment H, 69140 Rillieux-la-Pape (FRANCE) and bearing the SIRET number: 301 609 434 00040.

By the mere fact of the order, the buyer acknowledges having read our general conditions of sale and having accepted them. Any contrary clause not having been the subject of a written acceptance on our part would not be opposable to us.

2. Order

Orders are placed on the internet at www.raccordspro.com. Furthermore, AXESSPACK® reserves the right to refuse or cancel any order from a customer with whom the company may be in dispute (such as non-payment of a previous order).

Order validation
By confirming the order, the buyer acknowledges having read our general conditions of sale and having accepted them. Any contrary clause not having been the subject of a written acceptance on our part would not be opposable to us.

3. Price

The prices indicated on the website are expressed in euros, excluding VAT (excluding taxes) and delivery costs (unless otherwise indicated). All orders are payable in euros. Prices are subject to change at any time. AXESSPACK® nevertheless undertakes to apply the rates in force indicated on the site at the time of your order.

Any amount not paid by its due date will be increased, after our sending of a notification by registered post with AR, of penalties at the rate equivalent to one and a half times the rate of legal interest in force on the date of due date for payment of the invoice concerned and the amount of the lump sum indemnity for recovery costs due fixed by article D.441-5 of the French Commercial Code. These penalties will be payable on request.

4. Payment Terms

An advance payment, at the time of the order, is required by the Raccordspro online store; no cash payment upon delivery will be authorized.

Whether you are a new customer or already a customer, Raccordspro offers you different possible payment methods:

  • You can proceed to the payment of your purchases by bank card using our partner CM-CIC Payment
  • You can pay for your order via your Paypal account
  • You can also make a bank transfer using your RIB

5. Availability

Orders are fulfilled as long as the products are visible on the online store and while stocks last. In the event that one of the products ordered is not available in our stocks, AXESSPACK® undertakes to contact you by email or within 15 days from the date of your order in order to inform you of the next availability of the products in question. The buyer can then cancel his order, if he wishes. If the payment has been validated, we will offer you a credit or a refund of the amount of your order.

In addition, the "product" availability displayed on the website, if any, is given for information only and does not in any way represent a contractual commitment.

6. Delivery terms

Delivery times begin to run upon receipt of payment. These deadlines being given as an indication without engagement, a delay could not justify the cancellation of the order, nor give place to indemnities or penalties. Delivery is deemed to have been made as soon as the equipment is taken over by the transporter on our premises. Our goods travel at the risk of the buyer regardless of the mode of transport and delivery conditions, even if the prices are set "carriage paid". It is up to the buyer to carry out all checks and, in case of missing or damaged, to make himself all the reservations that he deems useful with the responsible carrier. We are released from the obligation to deliver by any force majeure or fortuitous event (strikes, etc.).

7. Cancellation period / Returns

Retractation

The buyer has the right of withdrawal provided by law (article L121-20 of the consumer code) for any purchase made on Raccordspro.com. The buyer has a period of fourteen (14) days to exercise his right of withdrawal and thus return one or more products which would not satisfy him, without having to justify his decision. The costs of returning the products are borne by the buyer. The period of fourteen days (14) runs from the receipt of the products.

The products must be returned in a completely new and complete condition (instructions, accessories), returned in their original packaging. Any product that has been damaged, or whose original packaging has been damaged in conditions beyond its simple opening will not be returned or refunded.

Procedure:

To exercise his right of withdrawal within the period of fourteen (14) days, the buyer must:

  • Access your customer account.
  • Click on "Order history".
  • Select the order reference.
  • Select the product(s) you want to return by checking the box next to their name(s).
  • Specify a reason for return (optional)
  • Click on the "SEND" button (an email confirming the withdrawal is automatically sent)
  • Print your invoice
  • Return the product(s) to Raccordspro.com (along with your invoice) to the following address:

After acceptance and receipt of the returned material, Raccordspro.com will be required to reimburse the buyer for the full amount of his order, within fourteen (14) days, using the same means of payment. It is nevertheless possible to complete the transaction with another means of payment, provided that you have obtained the buyer's agreement and do not incur additional costs.


Returns

For any purchase made on Raccordspro.com, the buyer has a period of thirty (30) days to return one or more products that would not satisfy him. The thirty (30) day period runs from the receipt of the products. In all cases, on the outward journey as on the return, the packaging and transport costs are the responsibility of the buyer, except in the case of an internal error (reference error, quantity error).

In the event of an internal error, the costs of return and / or return will be borne by Raccordspro.com. The buyer will provide Raccordspro.com with proof of return of the package with the price, to allow reimbursement of the return.

After acceptance and receipt of the returned material, Raccordspro.com sends the buyer a refund corresponding to the value of the returned products, using the same means of payment. It is nevertheless possible to complete the transaction with another means of payment, provided that you have obtained the buyer's agreement and do not incur additional costs.

  • We inform you that we do not practice exchange
  • Products returned and validated by our services are only reimbursed
  • If you want to receive another product, you will need to place a new order on our online store

 

8. property rights

Any reproduction, even partial, of our products is illegal (see article L.124.4 of the Intellectual Property Code, law 92 to 597 of July 1, 1992) and would constitute an infringement punishable by articles 425 and following of the Penal Code. In accordance with Law No. 80,335 of May 12, 1980, all of our goods are delivered and sold subject to full payment for them.

9. Guarantee

The warranty conditions of the products purchased are specified on each product sheet of the online store. The warranty starts from the date of delivery.
This contractual guarantee is reserved for products subject to normal use. It is in addition to the legal guarantee applying to hidden defects (see article 1641 of the civil code). Our warranty excludes the consequences of normal wear or those of abnormal use or lack of maintenance. If the legal warranty is called into play, it is recalled that the client must act within a short time from the discovery of the hidden defect (see article 1648 of the Civil Code) and provide proof of the existence of the defect.

In the case of a return under warranty, contact us by email or by post. We will send you a return slip and will cover the shipping costs. Shipping costs will be at our expense. Once the repairs of the said product have been made, we return the products to you at our expense.
If it turns out that the warranty cannot be applied, we will inform you, if necessary, of the cost of any repair. No repairs will be made without your agreement. The return of the product will be at your expense.

10. Technical specifications

The characteristics of the articles mentioned on the aforementioned website have only an indicative value. We reserve the right to make any changes we deem appropriate, even after receiving the order, without however affecting the essential characteristics.

11. Secure payment

12. Major forces

In the event of force majeure such as strikes, wars, problems affecting the supplier, transport, natural disasters or others, neither the seller nor the buyer will be responsible for the non-performance of the contract. Each party will have the right to an additional period to ensure the purpose of the aforementioned contract.

13. Personal data

In the context of online sales, we collect and store your personal data for a defined period of time not exceeding the purposes for which it was collected. This information is essential for processing orders, delivering products and issuing invoices. They are strictly confidential and internal to Raccordspro.

14. Attribution of jurisdiction

Any dispute, whatever its nature, will be brought notwithstanding any clause to the contrary before the Commercial Court of Lyon, even in the event of a warranty claim.
